FCC eased limit of products operating at U-NII-3 (5.725-5.85 GHz) frequency according to FCC-16-24A1 publication. This publication will be effective in May 6, 2016

Reference:
§ 15.407   General technical requirements.
(b) (4) For transmitters operating in the 5.725-5.85 GHz band:
(i) All emissions shall be limited to a level of -27 dBm/MHz at 75 MHz or moreabove or below the band edge increasing linearly to 10 dBm/MHz at 25 MHz above or below the band edge, and from 25 MHz above or below the band edge increasing linearly to a level of 15.6 dBm/MHz at 5 MHz above or below the band edge, and from 5 MHz above or below the band edge increasing linearly to a level of 27 dBm/MHz at the band edge.
(ii) Devices certified before March 2, 2017 with antenna gain greater than 10 dBi may demonstrate compliance with the emission limits in Section 15.247(d), but manufacturing, marketing and importing of devices certified under this alternative must cease by March 2, 2018.  Devices certified before March 2, 2018 with antenna gain of 10 dBi or less may demonstrate compliance with the emission limits in Section 15.247(d), but manufacturing, marketing and importing of devices certified under this alternative must cease before March 2, 2020.


Summary:
FCC 16-24 main revision:  for products operating at U-NII-3 (5.725~5.85 GHz) frequency, out-of band emission limit is loosen.
There are two test methods available for U-NII-3 /OOBE.
1. Adopt FCC 15.407(b)(4)(i) limit
2. Ad0pt FCC 15.407(b)(4)(ii) limit/same limit as 15.247(d):  when this method is applied, please refer to below chart:

Cerpass solution:
1. Cerpass will adopt FCC 15.407(b)(4) limit before May 6, 2016.  After due date, Cerpass adopts FCC 15.407(b)(4)(i) limit by easing radiation limit for products operating at U-NII-3 (5.725-5.85 GHz) frequency. 
2. As the test method currently adopted is stricter than that after effective date, if customer products passes current test method, there are no worries of failure afterwards.
 
3. Please note that FCC-16-24A1 doesn’t apply to 15.37(h) & KDB926956 D01 U NII Transition Plan that allows product tested according to old standard to be marketed as late as June 2, 2016. 
4. For on-going projects, PM shall confirm with customer which method to test.
5. For future projects, PM shall inform customer about FCC-16-24A1 publication
6. For products that had obtained certification before May 6, 2016.  Re-test on U-NII-3 (5.725-5.85 GHz) shall be done if customer requests to test using FCC 15.407(b)(4)(i) method.
